Section 60 Notices and Section
61 Agreements come from the Control of Pollution Act 1974
which gives powers to Local Authorities to control noise and
vibration from construction sites. The basis of the Control
of Pollution Act is that Best Practical means should be used
to control noise and vibration pollution.
A Section 60 is an abatement
notice that is served by the Local Authority to the person
responsible for the noise, requiring specific controls to
be put into place to minimise noise and vibration.
A Section 61
is a formal agreement between the contractor and the Local
Authority. This agreement has to be applied for before work
commences and allows the contractor and Local Authority to
agree noise levels and hours of work.
