Compliance


We are continually seeking ways of improving our performance, including the application and demonstration of best practice. For examples, we are involved in six Movement for Innovation Projects. As a minimum we are committed to complying with appropriate legislation. However, even with the application of our environmental management systems we received environmental complaints and were investigated by regulators on a few occasions during 2001.

The following sections highlight the main areas of complaint and non-compliance.

Complaints

Due to the transient nature of our operations it has often been difficult to gather accurate information relating to the number of complaints received within any given period. Therefore, we have refined the way in which business groups report complaints to the centre. This has allowed us to capture more detailed information which enables us to more effectively determine where our operations most frequently inconvenience others and therefore may result in complaints.

This more effective process for gathering information is reflected by the fact that we recorded a total of 244 complaints during 2001. This is an increase of 52% when compared to 2000.

The types of complaints received indicate that noise and dust/mud nuisance are the most frequent cause for complaint. 98% of the complaints relating to dust/mud were received by the M6 Toll Project. This is therefore a significant issue for the project and is an area where it has actively sought innovative ways of reducing risk and therefore complaints. For example, the contract is proactively reducing its impact at the Belfry Golf Course

In contrast, during 2000, the second most complained about issue was spillage. This resulted in the business groups actively seeking to reduce spillage of harmful materials, such as diesel. This has been successfully achieved and is demonstrated by the fact that only 2 complaints were received during 2001 which relating to spillage.

As with the analysis of the complaints per month in 2000, there was a peak of complaints received during the summer months, which indicates a link between the number of complaints and leisure time spent outdoors.

Environmental Prosecutions and Notices Served

During 2001 we are pleased to report that none of our business groups were prosecuted in relation to environmental incidents. This demonstrates that we are effectively managing our legislative obligations.

Carillion Building received 4 Section 60 Notices during 2001. All were resolved with the relevant Local Authorities and no further action was taken.

Cayenne Court, Southwark, London Carillion Building received a routine Section 60 Notice regarding work taking place at Cayenne Court, Southwark, London. A report was put together on site for the Environmental Health Officer and working hours were shaped around the needs of local residents.

Carillion Building

City Inns, Westminster, London Carillion Building at the city Inns project in Westminster, London received a Section 60 Notice (routine issue) following a complaint from a resident about an early delivery. The delivery had been instructed to arrive early by the Metropolitan Police due to the state opening of parliament, all road were to be closed by 08.00hrs. The issues surrounding a notice like this typically imposes restrictions that apply outside normal working hours. Carillion Building has developed effective controls within their management procedures to control such issues.

Carillion Building

26 Shad Thames, Southwark, London Carillion Building received a Section 60 (noise) notice for its operations at 26 Shad Thames, London. The notice was from Southwark Borough Council. Routine preventative measures were undertaken by the project.

Whitechapel West Site. (London Borough of Tower Hamlets) Carillion Building received a Section 60 notice by the London Borough of Tower Hamlets. The notice was regarding noise from the Whitechapel West site. Upon visiting the site the Environmental Health Officer was happy with the noise levels being generated on site. The notice was issued due to a complaint to the council from a local resident.
 

Carillion Construction

Cumbria The Environment Agency is investigating an issue concerning importation of materials for use in the control and eradication of Foot and Mouth Disease. Carillion Building is assisting the Environment Agency with their enquiries on this matter, which refers to materials imported under the instruction of our client.

M6 Toll Project A letter of informal caution was issued by North Warwick Borough Council to CAMBBA, following a complaint regarding night-time deliveries which were out with the permitted hours of work in the agreed Section 61 Consent. Out of hours deliveries have been suspended.

M6 Toll Project An Abatement Notice was served to CAMBBA, under the Environmental Protection Act, following a release of dusts. This notice was not appealed and remains in force for the duration of construction.

M6 Toll Project Silt run-off during extreme storm conditions caused pollution of a watercourse on the Belfry Golf course. A warning letter was issued to CAMBBA under the Water Resources Act. The project has been working in conjunction with the management team at the Belfry Golf Course to prevent further occurrence.

Carillion Construction

Cardiff Hilton Carillion Construction were fined £14,000 for breaching the 1974 HSWA and £2,000 for breaching PUWER and received costs of £4,700. The fines were received following an incident in July 1999. A document highlighting the lessons learnt was circulated to relevant people within the group.
 

Carillion Construction

Proof House Junction Carillion Construction were fined £15,000 and received costs of £1,194.50 for charges under Section 3 of the 1974 Health and Safety at Work Act. A document highlighting the lessons learnt was circulated to relevant people within the group and a reminder of the control processes in place was issued.
 

Carillion Building

New Accommodation Project An improvement notice was issued at the New Accommodation Project for inadequate canteen facilities. The canteen facilities were upgraded within one month.

This clearly demonstrates that we are managing to control the most significant impacts of our business but that there are still areas where we can improve.
